Why You Need a Will and Trust
Everyone needs a will and trust! Creating these two legal tools is essential for ensuring that your assets are distributed according to your wishes. By working with our Macungie wills & trusts lawyer, you can protect your assets, minimize taxes, and ensure your loved ones are taken care of.
- Wills allow you to clearly state who will receive your assets, who will be the guardian of your minor children, and who will execute your estate.
- Trusts help you avoid probate, provide protection from creditors, and offer more control over how your assets are distributed.
Our firm is here to guide you through these decisions and help you craft a plan that sets your family up for future success.
Benefits of a Will
A will is a legal document that outlines how you want your assets distributed and who will care for your dependents upon your passing or incapacitation. It’s essential to name an executor in your will—someone you trust to carry out these wishes. This person will be responsible for managing your estate and ensuring that everything is distributed according to your instructions.
However, there are some limitations to a will. For instance, a will doesn’t protect you from probate, a court-supervised process where your will is validated. This can be time-consuming and costly for your loved ones. To avoid probate, it’s usually recommended to also establish a trust, which provides additional protection and flexibility for your estate.
Benefits of a Trust
Trusts can offer more robust protection. A trust ensures that your assets are transferred directly to your beneficiaries without going through probate, helping to speed up the process and reduce legal costs. A trust can also protect your assets from creditors, bankruptcy, and divorce!
Trusts can be particularly useful for those with complex estates, minor children, or specific instructions for asset distribution. Whether you’re considering a revocable trust or another type of trust, our Macungie wills & trusts lawyer will help you determine which type of trust is right for your situation!
Updating Your Will and Trust
Life is full of changes, and your estate plan should reflect that. It’s essential to update your will and trust as major life events occur, such as marriage, divorce, the birth of a child, or purchasing a home. By keeping your estate plan current, you ensure that your wishes are always honored, no matter how your circumstances change! Our Macungie wills & trusts lawyer can help you modify your documents as needed to keep your plans aligned with your life and goals.

Will & Trust FAQs
What is the difference between a revocable and irrevocable trust?
A revocable trust can be changed or revoked by the grantor (the person who creates it!) during their lifetime, while an irrevocable trust cannot be modified at all once it is established. Irrevocable trusts offer stronger asset protection and tax benefits, but the disadvantage is if you add family members, or your circumstances change, the trust terms can’t be changed to reflect them. Our lawyer can help you determine which type is right for your exact needs!
Is a living will the same thing as a will?
Yes and no – a living will is technically not the same thing you might think of when you think of a last will and testament! It is actually more accurately an advance directive, and unlike most other types of wills, it can go effect during your lifetime if you suffer a health issue that renders you incapacitated and unable to make decisions for yourself. Most other wills only go into effect upon your passing. (We think you should have both!)
Do I need a lawyer to create a will and trust?
While there is no legal requirement for you to work with an attorney, these are complicated legal documents, and if you want your will and your trust to be valid and effective, you can’t make mistakes! Working with a professional ensures that everything is set up correctly for your family.

Josh we wanted to take a moment to thank you from the 3 of us from the bottom of our hearts. You are a gift and you have such a gift in what you do and they way you actually do it.
A total class act with the perfect personality for your profession. We can’t tell you enough how much we appreciate you and honestly thank so much. And it won’t be the last you see of us. Much Appreciation. The Stine/DiGiovanni family
*We highly recommend Joshua Daly for Elder Law, wills, etc. This is something that people don’t know what can happen when your parents pass away or what to do. Josh helps prevent as much as you legally can the home and assets being taken by elder care home and/or govt.
What a great experience on a subject people don’t like to talk about but is so important. Josh makes this process pleasant. We are recommending Josh to all our friend and family and friends. Everyone should get their ducks in a row. I am glad we met Josh & finally did this!
Thank you Josh
